These Terms of Service (“Terms”) govern your access to and use of the Navigate Your Cargo website and the Safety Manager Course and related materials (together, the “Service”), operated by Navigate Your Cargo (“Company”, “we”, “us”). By creating an account, purchasing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
- You must be at least 18 years old (or the age of majority where you live) to purchase or use the Service.
- You agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity under your account.
- Accounts are personal and for a single user. You may not share, sell, or transfer your account or access.
- We may suspend or terminate accounts that violate these Terms.
2. License to course content
Upon enrollment we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access the course content for your own educational use. You may not copy, record, download (except where a feature expressly allows), reproduce, republish, distribute, resell, sublicense, or create derivative works from any part of the Service.
3. Educational purpose — no professional advice or guarantee
- The Service is educational and informational only. It is not legal, compliance, financial, tax, or professional advice, and it is not a substitute for reading the applicable FMCSA/DOT regulations or consulting a qualified professional.
- Any certificate you receive is a certificate of completion. It is not a government-issued, accredited, or licensing credential, and it does not certify or authorize you to act as a regulatory official.
- We do not guarantee any specific outcome, including employment, income, results, or that any third party will recognize the training. Any examples or testimonials are illustrative and are not typical or promised results.
- You are solely responsible for how you apply what you learn, and for your own compliance with all applicable laws and regulations.
4. Purchases
- The course is offered as a one-time purchase for lifetime access, as described at checkout. Prices may change, but changes do not affect purchases already made.
- You authorize us and our payment processors to charge your payment method for the amount shown at checkout.
- Refunds are governed by our Refund Policy.
5. Acceptable use & anti-piracy
You agree not to share your access with, or provide course content to, any third party; not to scrape, mirror, resell, or redistribute the content; and not to circumvent any access controls. Because unauthorized sharing causes harm that is difficult to quantify, you agree that we may pursue all available remedies, including suspension, termination without refund, and recovery of damages and legal costs.
6. Intellectual property
All content, trademarks, logos, videos, and materials in the Service are owned by Navigate Your Cargo or its licensors and are protected by law. No rights are granted to you except the limited license in Section 2.
7. Disclaimer of warranties
The Service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the content is accurate, complete, current, or error-free, or that the Service will be uninterrupted.
8. Limitation of liability
To the maximum extent permitted by law, Navigate Your Cargo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or lost profits or revenues. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service.
9. Indemnification
You agree to indemnify and hold harmless Navigate Your Cargo from any claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.
10. Governing law & disputes
These Terms are governed by the laws of the State of [State], United States, without regard to conflict-of-laws rules. Any dispute will be resolved by binding individual arbitration, and you and the Company waive any right to participate in a class action, except that either party may seek injunctive relief for intellectual-property or misuse claims.
